Legal Question in Civil Litigation in Texas

Ownership of Vehicle

My ex-boyfriend and I purchased a vehicle together last Feb. and we split up a month later. He retained ownership of the vehicle and has been paying on the note ever since. However he will be going to jail by the end of the week and he refuses to turn over the vehicle to me so that I may continue paying on the note. Both of our names are on the title and to my understanding I should have equal ownership of the vehicle. Is this true and what else can I do to get the vehicle that is leased under my credit?

Re: Ownership of Vehicle

If he is not going to turn it over, you could go take it if you had a key (as long as there was no breach of the peace, e.g. no body saw you). You could hire a repo man to take it if you could prove that you have equal ownership. These people are expert at taking vehicles. But the best alternative for you is to go to court and get an order, but you've waited kind of late to start that process.
