Legal Question in Civil Litigation in Texas
Paid $1200 for a congenitally ill puppy.........
I bought a $1200 registered English Bulldog puppy from a breeder. I signed a one day health guarantee contract stating that the purchase price would be refunded if vet proves puppy has congenital defect. He was diagnosed with a disease ONLY transmitted from mother to puppy. The symptoms did not start showing up until 28 days after purchase. In addition to original price of puppy, I have already spent hundreds of dollars for treatment of problem. Also, puppy will need continuous treatment throughout his life for problem.

You are entitled to a health puppy. Proof that the illness was not contracted from the outside while in your possession entitles you to recover the purchase price. You may have to sue, and the costs may exceed the benefits you seek.
