Legal Question in Civil Litigation in Texas
Why are people allowed to sue with NO evidence
Can bogus lawsuits be kept out of the court system?
People sue for absolutely anything these days and hurt other family's because they can.
When there is truly a case with NO evidence , but tons on the defenses side, can it be stopped before it starts???
The person suing and their lawyer have financially hurt my family.
If it does go to court and they loose (THEY WILL), will they have to pay our fees. It will show up in court that the plantiff is a liar, WE HAVE SO MUCH PROOF!!!!
How can people sue, just for the hell of it, and not be held responsible. Her lawyer is doing pro bono, because her cousin works for him. DOES NOT SEEM FAIR, NOTHING IS COMING OUT OF HER POCKET, BUT MINE IS EMPTY!!!!
What can I do to stop this case from going further and longer??
Will they be held responsible when they waste the courts time?
Will they be held financially resposible for inflicting hardship on a family ........... just because they wanted to???
Can her lawyer be held liable for filing a case that has no way of recover and proves to have no evidence to support her claim???
Our evidence is overwhelming!! Seriously, not just stating that, it IS. From police officers testimony, to eyewitnesses etc & the plantiffs own words.

Re: Why are people allowed to sue with NO evidence
You need to retain an attorney to file an answer in time.
Your attorney can ask the court to award sanctions and fees if there is no basis in law or fact for this lawsuit.
It is rare that such a motion would be granted. However a court could grant it. It would certainly get their lawyers attention and it may make him take a strong look at the case and whether he should continue representing this client.
