1. How can I legally use written witness affadavits in small claims court?
2. Is it appropriate to use an attorney in small claims court?
3. Once awarded a settlement, how long does the other party have to pay you?

1. No. Affidavits are hearsay.
2. You may have an attorney in small claims court, although it usually isn't necessary.
3. Once you have a judgment it is up to you to execute [collect] it. However long that takes, if the losing party doesn't voluntarily pay.
