Legal Question in Civil Litigation in Texas

repossession fraud

My car was stolen by a wrecker dirve that claims to be repoing my car October 2006. The car is paid for since 12/2005. There was a chase between my brother and friends trying to slow the driver down and in the process the driver was shot and the car ended up crashing into a taco stand and no one wants to pay for the damages done to the car, it's totaled, and he had no business stealing the car in the first place.

Re: repossession fraud

Find out who ordered the repo. If the repo driver was stealing on his own, then he's responsible. But if he was ordered to repo the car for some agency, then they're responsible for his actions.

Mr. Bradie is correct. You can find out from TxDOT Motor Carrier Division whether this driver was a legitimate tow truck operator; if he wasn't, then he is again personally responsible. Press charges and let a prosecutor look into the case potential.
