You are not required to respond to a motion to compel. Failure to do so, however, may result in a court order assessing certain sanctions against you. Such sanctions may include limiting: (1) your claims or defenses; (2) your ability to rely on certain facts, theories, or information that you failed to disclose; (3) the amount of damages you can claim if you failed to properly disclose them; and/or (4) your use of expert or fact witnesses at trial.
