Legal Question in Civil Litigation in Texas

who should be responsible?

Before my husban and I bought the house that we live in, our water company dropped a heavy piece of equipment that damage the entrance of our driveway. It was a battle, however they sent someone out to repair it.The trash company that we do business with (a dumpster) has us with a 5 year contract, they have pulled in many times and have destroyed the area that was repaired.I called the water co. and told them that I felt they had not done a very good job at repairing the entrance & they said sorry we repaired & it is all yours now. The trash co. hasn't & won't pick up because they say they can no longer get in but we are paid up and still have a dumpster full of trash and a 5 year contract. What do we do and who is responsible. I called the county attorney & they basically want no part. Please, what is the best steps to take? Margitta

Re: who should be responsible?

The water company repaired the damage they caused, so they are off the hook. The trash company isn't responsible for the condition of your drive. You have to provide access so they can fulfill their contract with you.

In short, you are going to have to have your drive rebuilt to withstand the access of heavy equipment.
