Responsible Party

1. The company I run owes a Staffing Agency 85,000.00 for labor rendered on jobsites. The Staffing Co. sued me for the money. I am not a partner, nor can I write checks or dictate policy can I still be liable?

If you have been personally sued for $85,000, I certainly hope that you have had a lawyer to answer the suit for you. And of course, you should be asking him the question that you have posed. Hopefully, your employer is paying the lawyer for you.

Unless you did something to make the company believe that he was contracting with you rather than your employer or you actively participated in some kind of fraud, there should be no liability on your part. Be sure that your status is noted in a "verified" denial as required by Rule 93.2. [Your lawyer will check this for you].
