Legal Question in Civil Litigation in Texas

Rights to vehicle

If the title to a vehicle is clear w/ no lien-yet there is an outstanding balance being disputed due to interest rate discrepencies-can a judge (no bar license) order the car to be relinquished to the origianl seller?(The title is in the name of the buyer-defendant)The seller is not a car dealership-is a private sale.

Re: Rights to vehicle

It does sound a little unusual. The only judges in Texas that are not lawyers are JP's, and they don't have the authority to issue an injunction.

However, if the transfer of title was based upon a mistake or error, a higher court may set aside the transfer and order the car returned or repossessed.
