Legal Question in Civil Litigation in Texas

Rule 11 Agreement - Civil Case

We have a Rule 11 agreement between 4 parties regarding 2 pieces of property that were obtained because of a death. All 4 of the parties have agreed to sell both properties for 5% +/- the appraisal. 1 of the parties refuses to sign the sale documents eventhough the offer was 35% over asking price, and now has put in an offer for 5% lower than asking and wants us to sell. This person has already violated the rule 11 once and now is ready to do it again. We have a lawyer, but already owe him $50k on all of this and don't want to spend anymore money. What is our recourse and what can we ask the court to have this party pay for (attny fees, etc)? Trying to save a little money since our part of the properties is going to our attorney.

Re: Rule 11 Agreement - Civil Case

Your lawyer is the one you should ask for advice...and if he has taken you this far, don't ruin the case by self help...You could ask if the recalcitrant person would be required to pay attorney fees..
