Legal Question in Civil Litigation in Texas

School culpability

My daughter was convicted of a crime. Years later she enrolled in a paralegal degree program because the lawyers at the school she went to said that her conviction wouldn't be a problem for her since the charges were adjudicated. Now, after completing the course, the DA says her record can't be expunged. She now owes loans for a useless degree because the school lawyers told her a lie. Should the school be held accountable?

Probably not. Recall the old consumer warning, "Caveat Emptor" - or "buyer beware?" It applies here. Before your daughter went through the school program and obtained her degree, it was up to her to check out the school, its reputation, its graduate placement record, and so on. As for the lawyers giving their opinion, you cannot sue someone for giving their opinion. The real problem here is that our economy is in the tank and its going to be difficult for your daughter, as well as anyone else, to find work. She simply needs to continue looking and not give up. Rejection is part of it.
