Sole proprietorship: Who to sue?

In April 2005, I hired a sole proprietor construction company (no dba on file at the time) for a job which he did not complete. In Aug 2005, the owner turned over the company to his son who filed a DBA under original company name. For a small claims case, should I sue the original owner or his son?

Sue 'em both, and let the judge sort it out. Make sure you state that they're jointly and severally liable in your complaint.
