Legal Question in Civil Litigation in Texas
My son was arrested for illegal drugs and the state is sueing him for $2,000 he had on his person. He only had a small amount can they do this?
Any legal recourse? He has 60 days to respond.

His recourse is to answer the lawsuit. If the State can prove that the money derived from the sale of drugs, was intended for the purchase of drugs, etc., then the money is subject to forfeiture.
He needs a criminal lawyer. Hire one and confer with the lawyer on this matter, too. It may be an avenue of the lawyer conducting some discovery on behalf of your son.
