Spouse liability in a wrongful death or injury

If my spouse, as a result of DUI, kills or injurys another, and he is sued, what is my liability i.e. will I lose my home and other assets?

You would be liable only to the extent that you were actively involved in the incident that resulted in injuries. If you have separate property that has not been comingled into community property, that would still be yours. If you have community property, that would have to be separated to pay for your spouse's liabilities. More than likely your house would not be subject to fofeiture in Texas because your homestead is exempt.
