Legal Question in Civil Litigation in Texas

stock laws

A neighbors cattle have been on our place in San Saba County for over two months. They are two places removed from us so we can't just run them back on their place. I can't get them to come & pick them up & they won't sell them to me. What can I do to resolve this?

Re: stock laws

One thing is for certain, if you keep letting them graze on your land the owner will eventually get the right to do that. So you need to either fence off your land or take them to court to keep the cattle off your land. I can research what rights you may have to the cattle or compensation; you probably can claim the value of a cattle grazing lease because the owner has been getting that benefit without paying. No matter what you do, don't do nothing and don't use violence.

Send them a bill for grazing. Advise them in writing, certified mail, return receipt requested, that you have a pasturer's lien on the cattle for the grazing fee, that you have the right to foreclose on your lien, and that you can sell the cattle to pay your fee and the costs of auction.
