Legal Question in Civil Litigation in Texas
I have a subsatantial judgement agains a non resident that owns a house in houston, TX. Is it possible to seize the property by paying the existing mortgage off and avoid an auction?

Does he live in the house? Is it homestead? Would he claim an intent to return to the house (and live there)?
You can't avoid an auction by paying off the mortgage.
