Can I sue company not in Texas?
I filed a lawsuit in the small claim court against XXX Bancorp Services. I received a letter from a lawyer from XXX Bancorp Services stating that I have sued the wrong defendant because XXX Bancorp Services does not have a business relation with me. However, he stated the following:
1. XXX National Bank (PNB not PBS)is the proper defendant.
2. PNB is domiciled in New Hampshire and does not have any branches, offices in Texas.
3. PNB is investigating my claim.
4. General denial of the claim.
I did some research before suing PBS. This is the only PBS I can find registered in Texas. My questions are:
1. What exactly does ''PNB is investigating my claim'' means as far as my lawsuit?
2. Do I need to re-file and sue PNB instead of PBS?
3. If so, can I sue PNB if they do not have a presence in Texas?
By the way, I am certain PNB has a branch in Dallas. Their web site stated this and give address/phone for contacts.

You can sue a company that has sufficient contacts with Texas to satisfy the traditional notions of fair play. You also have to make sure you are suing the proper party.
