Can I sue a person, in another state, for breech of contract, through small clai

15 months ago I purchased a dog from a breeder in Texas; however, I took possession of the dog in California. As per the contract, after my dog was spayed, and upon written confirmation from the vet, I was to receive the original paperwork to register my dog. After 5 months of constant requests and complaints (which I have copies of), I still do not have any paperwork and I am worried that there is a statute of limitations on registration. Since she is from Texas, and I took possession in California, can I sue her in small claims court?

You can probably sue in California, but since the breeder is in Tx you will have to go to Texas to enforce the judgment. On a more practical side, tell the breeder that he/she has 5 days to perform or you will start notifying the various clubs and breeder organizations for the breed, including the AKC.

If you have to sue you should sue for rescission, meaning you will return the puppy for the amount paid plus what it cost you to feed and care for the dog.
