Legal Question in Civil Litigation in Texas

I'm being sued?

I am being sued for an accident involving my brother-in-law in a car that I gave him. We are trying to get my name off of the lawsuit but don't know how. How do I get my name off of the suit? Do I still respond to the lawsuit (ie:answer, demurrer)?

Contact TxDOT and get the car title changed from your name to your brother-in-law's name. Then send this to the plaintiff's attorney and then you may still have to file an answer to avoid a default judgment against you, which it would be a hassle to get corrected.

If you no longer have any connection to the car, you may be able to file a motion to dismiss. However if the car is still entitled to you, you are going to have to file an answer to avoid a default judgment against you and depending on the circumstances, you may still have some vicarious liability for negligent entrustment if you retained any ownership interest in the car.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
