We are being sued in a civil case, but own nothing. What can they take if they win.

Texas is often called a debtors paradise because of its exempt property statutes. Only nonexempt property can be taken to to satisfy a civil judgment. If you have nothing to take, and someone obtains a civil judgment against you, they can wait until you do have some nonexempt property such as lottery winnings, and then take that.
