can be sued on discrimination?
At first, thanks for paying attention for my asking . I would like to get some ideas about what could happen about the case I am writing now to. Since we are not American, I believe that how things are important in this country. What happen was,,My girl friend, who comes to USA to study, and working as part time at restaurant. A few days ago, she got customer, and had argument with her after they finished eating. Complained about her services, etc, and she gave back the tip to them because she was upset. There were several argument between them, and she accidentaly mentioned the word ''Black people''. the customers were African-American, and they said to her that they will sue for her on discrimination. I know that we shouldn't use the word ''Black People'' in any circumstances. She doesn't speak English well, and I know that she was careless to say that,it's her fault in any reason. After she calmed down, she was trying to apologize to customers, but they wre very angry and said they are going to the restaurant and her. They took her picture by their cell phone etc,,, . They also complained that to a manager and asked refund. The manager apologized them and gave their money back. Now we don't know what will happen. will be sued ?

I am sorry for your sister's bad experience. Waiting tables is a hard job. I have great respect for the people who do it.
In the United States anybody can file suit. However, if her customers file, it is unlikely they will win.
Lawsuits are about recovering damages. On the facts you describe there are no damages that these people suffered beyond hurt feelings. They were served, they ate, and they even got their money back.
I would be more concerned abour your sister keeping her job. Make sure she explains her version of events to the manager.
