Legal Question in Civil Litigation in Texas

Sued for taxes on property belonging to others.

On 10-24-00 I received certified mail informing me I have been sued for back property taxes on an apartment project,$300,000.00 plus.

I am one of several defendants named (all sub-contractors)due to having filed leins on the project for non payment as stipulated in our contract(s).

Not only have I lost money on labor contract but to be sued for property taxes for something I can't seem to seize appears to be a double whammy.

How does one deal with a situation such as this without spending MORE money on legal fees or having a judgement filed at the court house?

I used to work for a tax collection law firm - maybe the same one suing you. You were included as a named defendant because you were in the chain of title. In order to obtain a judgment on the property tax lien, subordinate lien holders must be removed. The owner of the property is responsible for the taxes, and if not paid, the prperty tax lien will be enforced at a tax sale.

I would suggest that you at least answer this lawsuit with an attorney or on your own. It might provide you an opportunity to realize some of your money out of the project.
