Theft-Tools of the Trade

Former Employer is keeping over $15,000 worth or tools because I owe him $1256.78. Would not give me enough work to pay off debt. Under what law can I Sue for return of my

property and in which Court, Small Claims Court or Judical

Court.

Small Claims has a judicial limit of $5,000.00 and not a penny more. You're going to have to sue for return of your tools in either County Court or District Court, depending upon the county you're in.

Before you bring suit, though, write to your former employer, certified mail return receipt requested, demanding return of your tools or the dollar equivalent to buy the same. Give him 10 days to get the tools or the money to you.

Then find an attorney that'll handle a lawsuit for the tort of conversion.
