Legal Question in Civil Litigation in Texas

Ticketed for Drug Paraphenalia

My son received a ticket from a city police officer while he was not driving his vehicle. He was asked for his ID and when he walked to his vehicle to get it, the officer shined a light inside and saw a pipe (empty, no drugs were found after a dog search). His ticket is for drug paraphenalia and the citation is on an everyday traffic ticket form. The officer told my son that this offense wouldn't go on his record and that all he has to do is pay the ticket ($165). Is this true? If he pleads ''no contest'' and pays, will this offense show on his record? His insurance? Should we fight this or should we pay it and be glad it wasn't worse? I know, I asked 3 questions...thanks for any help!

This is not a civil charge; it is a criminal charge. I recommend that you and your son speak with a criminal defense attorney as soon as possible.

Speak with a criminal defense attorney regarding deferred adjudication or the possibility to getting the ticket dismissed. While the ticket may not affect his insurance, it may be something you would not want to be on his record in the long term.
