Legal Question in Civil Litigation in Texas

unauthorized use

I own a mobile home and the lot it is on. It is located in an adult retirement park in South Texas. I recently moved into it full time after being in Tenn. working for the past 4 years. I have numerous reports from other residents in the park that one of the residents used my driveway to park his extreamly large Motor Home. He never aquired permission from me and I am not in agreement with his unauthorized use of my property. I want to write him a bill and present it to him for storage fees but I need to know from you if there are laws to protect me and make him pay.

Re: unauthorized use

What he did was trespass upon your property. Your damages for his deliberate tort of trespass would be the equivalent storage fees if he used a storage lot for his RV.

Make sure some of the other residents will testify on your behalf about the RV being parked on your driveway.

Re: unauthorized use

Mr. Bradie is correct and you would benefit from having a local attorney handle this. You might be able to convince them to pay before you have to sue.
