Legal Question in Civil Litigation in Texas
if i have someone that was in the vehicle with me when i had an accident, but i was not at fault, and this person claims to be hurt, and wants i suppose to file a lawsuit against the driver of the other vehicle, would he have to file against me first being that he was in my car, even though i wasnt at fault?

The passenger can file against the at-fault driver exclusively, if s/he so wishes. In some cases, the passenger can also file against your insurance. Examples of this would be if you have full coverage, and there's not enough insurance to pay for his/her damages or if you have a no-fault rider on your insurance.
