Legal Question in Civil Litigation in Texas

Vet Looses Registered Female Boxer

I left my female boxer at my vet's office for boarding on Friday Aug. 19. When I went to pick her up the following Monday he informed me he didn't have her. When ask when she went missing - he can't even tell me a date. He can't even tell me if she was still there on Sunday, although he claims to have fed "all the animals" that day. Her kennel was totally enclosed in his building. He claims she had to have climbed a seven foot gate, climbed down, then had enough strenth to push open a "locked" back door. My boxer is small only weighing about 40 lbs. Any contact with this man has been initiated by me. After I told him I put an ad in the paper he informed me he had also. The sad thing is, his ad was for a tan boxer. Mine was a registered brindle (which actually looked red) certainly not tan. He doesn't even know what she looked like, nor did he bother to find out. This animal was left in his care. He has been very rude and anything but helpful. What legal recourse do I have? This has caused much pain for my kids and myself as our dog had been a part of our family for 6 1/2 years. Can I recover cost I put into this pet, or can I just recover "replacement" cost. Any help will be greatly appreciated.

Thanks

Although we love our pets, the law treats them as property. You might be able to recover for negligence and malicious intent.
