Legal Question in Immigration Law in Texas

Appeal a denial of a Fiancee Visa

Is it worth it to appeal a Fiancee Visa, or is it better just to start over?

Re: Appeal a denial of a Fiancee Visa

It is possible to appeal a denial but it is usually better to file a new petition with better evidence. The decision depends on the reason for denial. If, for instance, you do not meet legal requirements such as the meeting within 2 years, an appeal or a new petition will not help you.

You may email me with specifics so I can better guide you.

It depends entirely on the reasons for the denial. In some cases it is better to file a Motion to Reopen. Did you make the application yourself or through an attorney? Have an immigration attorney review all of your paperwork and correspondence.
