Applicability of TX divorce laws to H1-B worker

I am working in TX on H1-B visa. We have been seperated for 2.5 yrs. Prior seperation we filed taxes jointly. Also, I first came to US as a dependent on H4 visa.

I am unaware of my husband's current whereabouts. I only know his permanant mailing address in India (which appears on our wedding cerificate issued by the court in India)

Will the TX divorce laws be applicable in my case ? We have a 30 month old daughter who is a US citizen and she lives with me. I was advised by a family law attorney to check first with an immigration lawyer.

Yes...you can get divorce in Texas. Since you are no longer an H4 and have your independent H1B status..your divorce will not jeopardize your visa status in any way.
