Legal Question in Immigration Law in Texas
Attending college while applying for green card through marriage to US citizen
It is now april, I am hoping to start
application in may for my green card.
While the application is processing (I have
read that it takes about 6 months to get
the green card), can I go back to school for
fall semester (september)? I am currently
on H1B visa.

You can study in H-1B status, but you should continue to work for the H-1B employer if you want to maintain your H-1B status also. If you don't want to stay working, you could abandon the H-1B status. However, in that case you will need Advance Parole to travel and an EAD to work, if you want to work part-time while at school.
