Legal Question in Immigration Law in Texas
I am a Canadian Citizen presently in the US. My I-130 petition has been approved. I received e-mail from NVC and a case number MTL.......... I have come to understand that I will have to travel back to Montreal/Canada for the interview process. Is it possible to have the medicals and interview done without leaving the US ? I did not receive a I-94 as Canadians are on the visa wavier program, and so do not know my status in the US. Please help answer my question.

If your I-130 was filed by an immediate relative (US citizen spouse or child), you may remain in the US and file for adjustment. If your I-130 has been approved but you need to wait for an available priority date, you'll need to be sure to maintain lawful status and/or depart for consular processing.
I would concur with prior counsel's assessment. If your spouse is a USC, then you could adjust your status without having to leave the U.S. Call with questions at 214-741-1700.
