Legal Question in Immigration Law in Texas

us citizen child being sent to mexico?

We have 2 boys we foster and want to adopt. The birth mom (drug addicted) was deported so now she is getting her mother to ask for custody in Mexico. Both boys are US citizens. Can the judge send them to Mexico? Can you deport a US citizen? Are there any laws against it or codes or something? She is so drugged out: we are scared for her to even see them much less have them. We love these boys. Please help!!!! Thank you!!!

You have an immediate and complicated situation. More than you can resolve on your own. Hire a lawyer immediately. James Grissom is an attorney on this Board, and is in your area. (The judge would not be deporting the children. The judge would make a decision regarding conservatorship. Under conservatorship, the judge can restrict the child's residence. If the grandmother adopts the children, then she has the right to take them anywhere she chooses, as if they were her own biological children.)
