Legal Question in Immigration Law in Texas

i am a US citizen by naturalization, im looking into petitioning my parents who have lived in the US for more than 15 years out of status, came in legally with visitors visa.

my mother has worked for most of these years, stayed out of trouble. but not sure if we should report that she has worked in the immigraiton forms. she's always reported her taxes with ITN #.

my Father has worked here in the US with a made up SSN. reported taxes with ITN #, but he did have a DWI back in 2008. he was processed as a US resident with fake SSN. would This affect his case? should we report work history?

We see these cases quite often. It's nice that your father is being upfront about the issues. That helps in how we prepare the case and how the adjudicators will view him during the process. With that said its important to have counsel to help you frame the case in the best possible light to your parents. While visa petitions are not discretionary (meaning that the USCIS can't add in factors on whether or not to approve a case) and adjustment of status and a waive (if deemed necessary) are discretionary. So framing the case becomes very important. Feel free to give us a call. We handle these cases throughout the country for people just like you and your folks.
