Legal Question in Immigration Law in Texas
My EAD ended in June 2013 and Now I am on Cap Gap till Sep 30 as my H1B is still pending.
Are fresh H1B's processed before Oct1st? Or they can continue even after that.
Also, what are my options if my H1B is still pending post Oct1 st.

Your I-129 should be adjudicated before October 1st. You might want to consider premium processing if it is not adjudicated by September 3rd. I do not foresee any reason why your H-1B would not be adjudicated before October 1st. However, you should be consulting with the attorney who filed the I-129 on behalf of your prospective employer.
