Effect on E2 Visa if company sold

Hi there,

If my husband's UK owned company are sold to a non-UK buyer, how long can he stay in the USA on his E2 VISA? He is also a UK National and therefore I understand his Visa will no longer be valid.

If the UK owned company is sold to a non-UK entity, resulting in less than 50% ownership of the company by a non-UK entity, your husband's E-2 status would no longer be valid. In such event, there is no grace period. In order to remain in a period of stay authorized by USCIS, your husband would need to apply for a change of status prior to the sale.
