Becoming engaged to B1/B2 visa holder

My fiancee came into the USA on a B1/B2 visa to train with his company in NY. We have been friends for over 3 years. He came for a visit and we became engaged. We wish to marry but he will be returning to India. What do we do to have a legal marriage? I don't have an income. I do have assets. I have cash in the bank and own my home and property. Does this count or do I have to have an income for us to marry?

You have to be legally married in the United States. You also want to file the appropriate paperwork before he leaves, and he needs to obtain advance parole before he leaves. Your lack of income is not insurmountable; as an experienced immigration attorney can work with you on the Affidavit of Support.

You can apply for his permanent residence after marrying him. Your lack of assets means you'll likely need to get a joint-sponsor for the affidavit of support.
