Family based petition

I am US citizen and would like to file petition for my my Son who is over 21 and here in US out of status. I would like to seek waiver as my husband also a US citizen is terminally ill and my Health is very poor. My son who is literate take care of us with all medical need. Please guide us

It is always a wise decision to consult attorney that in skilled in immigration matters. Please consult one immediately.

Your son must qualify for cancellation for removal or have an approved visa prior to seeking any form of waiver. The earlier you file I-130 application for your son the better. There is a long wait for approval. At least if he is arrested a case can be made that he has a pending application. In the alternative, depending on the numbers of years that your son has been in the U.S, he may be a candidate for cancellation of removal. There may be other benefits and or options that are open for your son. Talk to a lawyer before it is to late for your family to act.
