How to get a fiance visa?

I have a B1-B2 Visa and I must leave USA March 3 and I am not sure if I will be able to come back. I have met a girl and we are talking about getting married in May...is there a posibility to change my status to a Fiance visa?...

Re: How to get a fiance visa?

You can't change status to a fiance visa.If you want to apply for a fiance visa, your fiance should file a fiance petition with the Texas Service Center. You should leave on time. The petition should be approved in about a month and you forwarded to the American consulate in your country of nationality. You will be processed abroad and will be allowed to reenter the US. You must marry within 90 days of returning to the US or dire consequences ensue. Then you would file for adjustment of status in the US.

Alternatively, you can marry in the US & file an I-130/I485 in the local INS office in your state. Even if you go out of status, you can still file if you are married to a USC.
