Filing alien petition
I am an illegal alien who has been in the US since 1990. I have been married to a US citizen for more than 5 years and never adjusted status. If I file now for an alien petition what are the chances of being deported, if any?

That depends on your status at entry. Either way, you should contact a lawyer to process this for you. If your entry was illegal, then you may not be able to adjust in the US, but you might qualify for a waiver so that you can get your green card outside of the US and still re-enter. If you are married to a citizen, you can begin the process immediately so that you can obtain a green card. In the majority of cases, filing a visa petition or application for green card, does not initiate deportation proceedings. Of course, your case depends on several other factors such as criminal history, if any, and your immigration history.
