When filling a VAWA petition to immigration. If i am currently working illegally is there a way I can still file for petition? Or is it better if I stop working to be able to file?

Hello:

It is not a problem as far as the VAWA goes. However, it is critically important you file a meritorious VAWA application or it will simply be denied.

You may file a VAWA petition if your lawful permanent resident or U.S. Citizen spouse has been abusive towards you. The fact that you have worked illegally will not prevent you from getting a VAWA petition approved. You should seek the assistance of an immigration attorney to ensure you are eligible for VAWA relief.
