Legal Question in Immigration Law in Texas

Hi , I am in the final steps of getting my wife her visa interview. I have heard a lot of people stating we need to get a waiver for her being in the united states. So we went ahead and started the process with the people helping us out. Now the question is this, my wife was told by another lawyer that she did not have to do that because she came in to the united states when she was only 16 yrs old. We have been in this process for about 2 years. I am a united states citizen and she has no criminal record, went to high school here and got her diploma , even a license to practice cosmetology. I am confused and am wondering if the people helping us know what they are doing. Any help ?

Hi. Based on your submission an answer cannot be given because certain facts are not provided. Did your wife enter with a visa or through a checkpoint at 16 years old? Or did she run the border? If the former, did she ever depart the U.S. and return and if so when and how? If she ran the border did she apply and was she approved for DACA when it came out in 2012? Feel free to give us a call for a second/third opinion but please have her on the phone and please allocate about 30-45 minutes for us to talk with you and ascertain what you need to get done to keep your family together.
