Legal Question in Immigration Law in Texas
H-4 to F-1
Hi, I came with my husband (H-1B) in Feb 2008 on an H-4 visa. My married life is not going well since then and he has abandoned me and left to go to India last week without informing me. Now he is threatening me that he shall cancel his H-1B in India and get me out of status. Can I still file for F-1 visa if at all he has cancelled his H-1B visa?? I havent left U.S. yet. Please reply as soon as you can as I am in a big stress.

Re: H-4 to F-1
Generally, an F-1 is issued in the home country. Go talk to one of the advisers in the Foreign Students Office of the college, or consult with an attorney, to determine if this is a viable option for you.
