Legal Question in Immigration Law in Texas

Hello,

I work on H1B visa for a big oil company as an Instructional Design Consultant. The company had stated in my offer letter that they will process my Green Card. However, the company is now not sponsoring the green card on the pretext that my position is not unique enough. I want to understand what options I have to get a green card. For your reference, I have a Masters degree and was hired into the company on a student visa and then converted to H1B.

My legal advise would be to consult an Immigration Attorney who specializes in employer sponsored green cards and ask them to assess whether your position is unique enough for an employment based green card. If, after reviewing your job description, resume, and previous H-1B visa petition documents the Immigration Attorney feels as though your position would qualify for an employer sponsored green card, you may wish to get a new H-1B visa and change to a different employer who would be amenable to sponsoring you for a green card.
