Legal Question in Immigration Law in Texas

My husband is in jail for drinking and driving and cocaine but i got a lawyer and they took those charges off him but now the problem is that they put him on immigration hold but im having a baby with him and he wants to fight the immigration hold is there a possibility they wont deport him?
