If an illegal tries to marry in the U.S will he be deported and have to pay a fine?

If one enters illegally (meaning with out a visa), they CANNOT adjust their status to that of a permanent resident even if they marry a US citizen. There are no exception unless that person has a "grandfathered" I-130 petition or a labor certification. If so they can take advanatge of the 245i law. Generally, if someone enters the U.S. illegally, and then marries a U.S. citizen, they will be eligible to obtain their permanent residency. However, several other factors such as previous immigration history and criminal history, will determine if a person is eligible to become a permanent resident.
