Legal Question in Immigration Law in Texas

My sister signed a voluntary departure and her turist visa was cancelled. In Brazil she tried another visa and the consul said she had worked in US. I belived my ex husband made a report to imigration. My sister denied she had work. We don't know which is the acusation and FOIA takes 1 year to be respond. Her fiance intends to get marry her in Brazil. Her fiance is american citizien. Is there possibility to get a imigrant visa with a waiver? How could we know what is in the report? The consul's answer allowed her to try another visa. What are the odds to the inadimissibilty been waiver?

Which cases are impossible. In case she lied to US autority is fraud? Is that possible to get a waiver?

It is difficult to understand the background of this case from you post. I understand enough, however, to know that her fiancee should not file on her behalf without the services of an attorney. If there is any hope of her attaining residence, it will be through the assistance of an experienced immigration lawyer. Whether or not her lies/fraud will stop her admission, depends on the materiality of the fraud.
