Legal Question in Immigration Law in Texas

My brother-in-law is an illegal alien and recently impregnated his American girlfriend. He wants to marry her and/or become a American citizen or permenate citizen. He has lived in the US for 4 years, has a job and been a very productive member of our society. What do we need to do?

Talk with an immigration lawyer privately through email or telephone or conference. If his entry to the US was illegal, his problems multiply. If he entered legally, and allowed his status to lapse, then he is in a much better situation. Even if his entry was illegal, he may still be able to obtain residency, only it is more complicated.

If your brother-in-law marries a U.S. citizen, his wife will be able to petition for him and he will be able to apply for permanent residency through consular processing. However, his previous immigration history and criminal history, if any, can determine if he is eligible for a green card or not.

Please specify whether he entered the U.S. initially on a visa or whether he entered without a visa or inspection. The difference is very important.
