Legal Question in Immigration Law in Texas

Immigration through Marriage?

I entered this country on F-1 student visa. I was arrested twice on the alleged Assault charge (misdemeanor A). However, one of the case went to trial and the jury found me ''not guilty'' and the other case was subsequently dismissed by the prosecutor. Now, I am planning on getting married to a US citizen next month. Would this past record entail any problem for me to get the EAD and greencard through marriage?

It should not negatively affect your application, however, since you have these issues, your package should be prepared by an attorney; so that it is properly presented to Immigration.

It is always better to seek personalized legal advice.

Based on the information on the two class A arrests, with a not Guilty verdict on one of the arrest and the other arrest dismissed, the two arrests have no legal effect on you.

Before the eyes of the law, you have a clean criminal record which is as good as someone no arrest reord.

However, if the assault belongs to a deportable class of assault offense, and you admit to the offense in some forum, it may have effect on your Immigration process.

GOOD LUCK.
