Legal Question in Immigration Law in Texas

Immigration Policies

1. When a person comes to America from another country to receive a green card but in the process falls in love with an American and they marry, he/she will automatically be given a green card is what I have heard. But what if they have a son or daughter, or a younger brother or sister? would they get a green card as well? And if so, what is the maximum age the child can be to get a card? 17?

2. Do foreigners need permits to visit America? Where should they go to get one? And does this differ in different countries? Do they need specific papers or documents to present? Or are they just a regular tourist that only needs a passport?

Re: Immigration Policies

If an alien marries a USC, then the USC can petition for the alien, and the alien can apply to adjust their status to LPR. It is not automatic, but if approved, there is no waiting list.

If they have a minor child, the child can adjust also, but not a sibling. The sibling would have to wait until the alien achieved citizenship status, and then be placed on a very long waiting list.

To visit the US, a person needs a B1/B2 visa -- a tourist visa. Application is made at a US consulate. The rules for visiting a different country vary.
