Legal Question in Immigration Law in Texas

international student marriage

Hi, I am an international student currently in good status. I am going to get married to a legal resident, and file for an alien number and work permit. How long will it take to get an alien number/ work permit? Will that make me illegal? What about file for asylum too because my families in africa are being persecuted?

Re: international student marriage

If you come in to the U.S. with a student visa (F-1)nd you marry a U.S. citizen while still in the U.S. then you are eligible to adjust your status to that of permanent resident in the U.S.. However, in your case, the marriage to a permanent resident will place you on a waiting list which could be for well over two years. check the visa bulletin at travel.state.gov/visa_bulletin.html and the marriage to a permanent resident would be under the category "2A". It would be advisable for the permanent resident to apply for citizenship immediately if possible (5yrs as permanent resident, good moral character, residing in the U.S. for over 2.5 years in the last 5 years and not leaving the country for more than a year at one time without a reentry permit.
